Conditions of Use of DeakinAir

DeakinAir is made available to Deakin staff and enrolled students for educational use only and not for personal or commercial use.

You must not use DeakinAir for any purpose or upload any content to DeakinAir that is illegal, unlawful, confidential or in breach of Deakin University's legislation, policies and procedures, including but not limited to Deakin's various Information Technology Use policies and procedures and the Conditions of IT Use. You must comply with all applicable international, Commonwealth, State and local laws and regulations. The videos stored in DeakinAir will be stored by Kaltura on servers in the United States. You must comply with the DeakinAir Copyright and Privacy Statement Deakin reserves the right to investigate suspected violations of these Conditions. Deakin may, in its sole discretion, remove infringing content from DeakinAir, provide warnings to you, or suspend or terminate your access to DeakinAir.

Limitation of Liability

Deakin is not responsible for the accuracy, usefulness or intellectual property rights of or relating to content posted to DeakinAir. To the extent permitted by law, Deakin University is not responsible for any loss or damage of any nature whatsoever arising as a direct or indirect result of accessing DeakinAir, or its content, or the uploading or downloading of any content to or from DeakinAir. Where Deakin University is unable to exclude liability, it shall not be liable for any special, indirect or consequential loss.

Indemnification

You agree to indemnify Deakin from any claims, losses, or damages, including legal fees, resulting from your violation of these Conditions or your posting of any content to DeakinAir, and to fully cooperate with Deakin University in defending such claims. Without limitation, you agree to indemnify Deakin from and against any and all claims, losses, actions or demands brought by or against Deakin alleging with respect to you

• breach of intellectual property rights,
• interference with privacy;
• defamation, libel, slander, obscenity, pornography; or
• offensive, harassing or illegal conduct.
